Gay Louisiana Teacher Intentionally Exposes a Student to AIDS

A Louisiana school teacher is behind bars for having sex with a student and exposing him to the AIDS virus. Knowingly exposing someone to a deadly virus — in this case a minor — means multiple felonies, but what if this student contracts AIDS from the illicit encounter — or if it’s determined to be a case of rape?

Some countries or jurisdictions, including some areas of the U.S., have enacted laws expressly to criminalize HIV transmission or exposure, charging those accused with: criminal transmission of HIV. Others, including the United Kingdom, charge the accused under existing laws with such crimes as murder, manslaughter, attempted murder, or assault.

Terrebonne Parish sheriff’s deputies arrested Derrick Nesby, 37, Wednesday at H.L. Bourgeois High School, the school where he teaches.

The 37-year-old is accused of having sex with a 16-year-old male student at the school.

“We can establish the fact that there was an encounter that happened,” said Terrebonne Parish Sheriff’s Chief of Detectives Malcolm Wolfe.

According to investigators, a resource officer at the school was the first to receive the complaints that Nesby was involved with a 16-year-old, but deputies would not say when or where the particular incident took place.

Investigators say Nesby was also a track coach and had only been employed at the school for a year. Detectives believe it was during the past school year that he engaged in inappropriate contact with the teen.

However, Nesby denies all the allegations.

“We continued our investigation where we established more evidence that something did happen, and at that point we got a warrant for his arrest,” Wolfe said.

What is even more shocking is that through the detectives’ investigation, they learn Nesby has AIDS.

Deputies say despite knowing he had AIDS, Nesby exposed the teen to the virus without his knowledge.

In addition to facing a charge of felony carnal knowledge of a juvenile, Nesby faces a charge of intentional exposure of the AIDS virus.
